What this is
These are the terms between you and The Kept Year LLC, a Utah company, when you use thekeptyear.com or buy a book from us. When we say "we" or "us," that's who we mean. When we say "your book," we mean the planner you build on our site and we print for you.
By creating an account, building a book, or paying for one, you're agreeing to these terms. If you don't agree with them, please don't use the site.
Your book and the proof
Every book is made to order. Nothing prints until you've built it, looked at a proof of it, and approved that proof. The proof is a page-by-page rendering of exactly what will print.
Approving the proof is the moment that matters. When you tick the approval box you're telling us: I've looked through this, it's the book I want, print it as shown. We record who approved it, when, from what device, and the price you were shown at the time.
If you change anything about the book after approving, the approval is cancelled and you'll be asked to look at a fresh proof. You can't pay for a book that hasn't been approved.
We check the proof for problems we can catch automatically, like a book that's too long for its binding. We don't proofread your names, dates, or dedication. That part is yours.
Prices and payment
The price of your book depends on what you put in it, and you'll see the running total the whole time you're building. The price you approve on the proof is the price you pay, plus sales tax where we have to collect it and any shipping shown at checkout.
Payment is handled by Stripe. Card details go straight to Stripe and never pass through us. Sales tax is worked out by Stripe at checkout based on your shipping address. Prices are in US dollars.
Once you've paid, your book goes to print. Because it's already being made for you, an order can't be cancelled after payment.
Shipping
We ship within the United States only, for now. Expect your book five to ten business days after you approve the proof and pay. Shipping is priced per book, shown in your cart and on the payment page before you pay, and taxed where your state taxes shipping. Books on any "Keep it coming" plan ship free. When it ships we'll give you a carrier and tracking number on your order page.
Please check your shipping address before you pay. If a book comes back to us because the address was wrong, we'll get in touch about reshipping it, and the second shipment may be at your cost.
Reprints and refunds
Your book has your name in it and exists nowhere else, so it can't be resold. That's why we don't take returns on a correct book.
If it's wrong, that's ours to fix. If your book arrives damaged, misprinted, misbound, or different from the proof you approved, write to [email protected] within 30 days of delivery with a photo of the problem. We'll reprint it free from the files you approved, or refund you if a reprint isn't the right answer.
A typo you approved on the proof isn't a misprint, and we can't reprint it free. Look the proof over carefully; that's what it's for.
Refunds go back to the card you paid with. We don't offer partial refunds or store credit in place of a reprint.
Promotional codes
We sometimes give out codes for a discount or a free book. A code can't be combined with another discount on the same order, has no cash value, and ends when we say it does. A free book from a code doesn't earn referral credit.
Keep it coming
"Keep it coming" is our subscription. Choose it at checkout and we'll make you the next book on the same rhythm as this one: a three-month book every three months, a four-month book every four, a six-month book every six, a twelve-month book every year. Every book it makes ships free, and your price locks. It comes three ways:
- Keep it coming. Each book is charged as it's made. You can skip one.
- The whole year, one time. You pay once for a year of books at 5% off. It doesn't renew.
- The whole year, kept coming. You pay for a year of books at 10% off, and it renews each year at the same locked price.
The two yearly options are offered on books shorter than twelve months. Checkout shows the price and what each one commits you to before you agree.
Your price never goes up inside a subscription. Each book bills the same locked total, even if the year's shape adds a page or two, or you add a section in its review window. Changing the book itself, like its size or length, isn't something your account page offers yet; write to us and we'll sort it out with you.
Before each book, you get a review window. About six weeks before your next book's first date we build it, render a proof, and put it on your account page. You have two weeks to look it over. When the window closes, about four weeks before the book starts, it's charged and goes to print, so it reaches you about two weeks before its first page. During the window you can:
- look it over and approve it,
- change what's in it, which starts a fresh proof at the same locked price,
- skip it (on "Keep it coming," where each book is charged as it's made), with nothing charged for that book,
- cancel,
- or do nothing.
If you do nothing, the book is approved for you when the window closes, your saved card is charged the locked price, and it prints. We record that it was approved by the window closing rather than by you, but it prints just the same. We tell you this plainly because a charge you didn't expect is the one thing we never want to be.
Cancelling is one click on your account page. It takes effect at the end of what you've already paid for. On "Keep it coming," if you cancel before a book is charged, that book is not charged and not printed. Change your mind before your plan ends and you can resume it at the same price. We keep your saved build after you cancel so that if you come back, your next book starts from your own setup rather than a blank page. If you come back after your plan has ended, the current price list applies.
A year paid up front. If you choose either yearly option, you pay once for every book in that year. We make each one on the same rhythm as your first, show it to you in its review window, and send it, just as above. A paid year has no skip.
If you stop a yearly plan, the books you've already paid for still come. Stopping ends the renewal; it doesn't cancel what's paid, so you get the whole year you bought. If something changes and you'd rather not have the rest, write to us.
If a renewal payment fails, Stripe retries the card over the following days. The book doesn't print until the payment goes through.
The free week
You can build a week of your planner and print it at home for free, as many times as you like, without paying anything or entering a card. We email the week to the address you give us. It's a real week of your real book, not a sample. It doesn't enroll you in anything, and we only send you news if you tick the box asking for it. If a creator's link brought you here, asking for the week also enters that creator's giveaway. If you later choose "Keep it coming," the terms above apply from that moment, and we'll show you the price and the cadence before you agree.
Referral credit
Every account has a referral code. It's printed inside the back cover of your book and shown on your account page. When it's live, here's how it works:
- Your friend gets 15% off their first book. It comes off the list price of that book, before any plan discount; shipping is charged as priced.
- You get one third of that book's list price as store credit. Only on their first book, and only once it has shipped and a week has passed with no refund and no payment dispute. Until then it shows as pending.
- Credit applies to your next book, including a book your plan makes. It can cover at most one book per order, and never shipping; any remainder rolls forward to the book after. A book is never entirely free: at least $5 of the book price is always charged.
- Credit expires 24 months after it posts. Using it needs an account whose email address you've confirmed.
- Credit has no cash value. It can't be transferred, sold, or paid out. It's a discount on a future book from us, nothing more.
- If your friend's order is refunded or disputed, the credit from it is cancelled, even if you've already used it. In that case the amount comes off your next book instead.
- Referring yourself, or a code applied to a book that isn't a first book, earns nothing.
Codes from our creator partners may carry a different first-order offer, shown when the code is used. The creator's side is covered by separate terms that each creator accepts.
We may turn a code off, or change what the program offers, at any time. A book already printed with a code keeps working: a friend who scans it gets the discount printed in that book or the current offer, whichever is better. A code that has been turned off, or one we don't recognize, still gives the standard first-book discount, so nobody who scans your book is turned away.
If we believe a code is being abused, we can withhold or reverse the credit from it and close the account. We'll tell you if we do.
What you put in your book
The name on the cover, the birthdays and anniversaries, the dedication: that's yours. You own it. You give us permission to use it for exactly one thing, which is to make and print your book, and to keep it in your saved build so the next book starts where this one left off. We don't use it for anything else, and we say so in our Privacy Policy.
You're responsible for what you put in. That means having the right to include other people's names and dates, and not putting in anything unlawful, or anything that infringes someone else's copyright or trademark. If a book would break the law to print, we won't print it, and we'll refund you.
Your account
An account is your email address. You sign in with a single-use link we email you, or with a password if you choose to set one. If you buy without signing in, we make your account at payment from the email on your order. Keep your email and any password to yourself; anything done from your account is treated as done by you. One account per person, please. You can build without an account, and the builds you make before signing in on a device join your account when you sign in on it.
We can close an account that's being used to abuse the site, the referral program, or the people who work here. We'd rather talk first, and usually will.
To close your account, write to [email protected]. What happens to your data when you do is set out in the Privacy Policy.
What's ours
The page layouts, the scripture study schedules, the artwork on the covers and tabs, the builder itself, and the name The Kept Year belong to us or to the people who licensed them to us. Buying a book doesn't transfer any of that; you can't copy the layouts to make your own planners to sell.
The printed book is yours to keep, write in, give away, and hand to your daughter in ten years.
What we're responsible for
We're responsible for printing the book you approved, well, and getting it to you. If we get that wrong, the fix is a reprint or a refund, as described under Reprints and refunds.
Beyond that, we provide the site and the book as they are. We don't promise the site will always be up, or that a planner will make a year go the way you hoped. To the extent the law allows, our total responsibility to you for anything arising from an order is limited to what you paid for that order, and we're not responsible for indirect losses like lost time or missed plans.
Some states don't allow limits like these, in which case they apply only as far as the law permits.
Utah law
These terms are governed by the laws of the State of Utah. If we end up in a dispute, we'll both try to sort it out by talking first: write to us and a person will answer. If that doesn't work, any court case is brought in the state or federal courts in Utah County, Utah, and you agree to that.
When these terms change
We'll change these terms from time to time. When we do, the version and date at the top change, and if the change matters to something you've already bought or subscribed to, we'll email the address on your account before it takes effect. A subscription always runs on the price and terms you agreed to; a change to these terms never raises a locked price.
